1. Agreement to These Terms

Miami Vibes Entertainment website or booking any of our services, you agree to these terms of service. If you do not agree with any part of these terms, please do not use our website or services.
These terms apply to all visitors, clients, and anyone else who accesses our website or hires us for an event in Raleigh, NC or surrounding areas.
3. Booking and Deposits
A booking is confirmed only after a signed agreement and any required deposit have been received by Miami Vibes Entertainment. Inquiring about availability or submitting a form on our website does not constitute a confirmed booking.
Deposit amounts and payment schedules will be outlined in your individual booking agreement. We reserve the right to decline any booking at our discretion.
4. Cancellations and Refunds
Cancellation policies are outlined in your individual service agreement. In general:
• Deposits are non-refundable unless Miami Vibes Entertainment cancels the booking.
• Cancellations made within 30 days of the event date may result in forfeiture of the full balance.
• If we are unable to fulfill a booking due to circumstances beyond our control, we will make every reasonable effort to provide a suitable replacement or issue a refund.
We strongly recommend purchasing event insurance for large events such as weddings or quinceañeras. Please review your specific service agreement for the full cancellation and refund terms that apply to your booking.
5. Client Responsibilities
When you book Miami Vibes Entertainment, you agree to provide accurate information about your event including the correct date, venue, and expected guest count. You are responsible for:
• Securing any necessary permits or venue approvals for the use of audio equipment, lighting, or photo booth services.
• Informing us of any venue rules, sound restrictions, or time limits that may affect our setup or performance.
• Ensuring that a suitable and safe space is available for our equipment setup and operation.
• Providing access to the venue at the agreed setup time.
We are not responsible for delays or service limitations caused by a failure to communicate venue requirements in advance.
6. Music and Content
We will make every reasonable effort to honor your music requests, must-play list, and do-not-play list. However, we reserve the right to use professional judgment when it comes to music selection, volume levels, and crowd management during your event.
We do not reproduce, sell, or distribute any copyrighted music. All music played during events is for live performance purposes only. We are not responsible for any copyright claims arising from music selections made specifically at the client’s request.
7. Photo Booth and Photography Services
For
photo booth and
photography services, the following applies:
• Images and videos captured at your event are your property.
• Unless you opt out in writing, Miami Vibes Entertainment may use event photos or video clips for marketing purposes including social media, our website, and promotional materials. Faces and identifying details will be handled with care.
• We are not responsible for equipment failure caused by external power outages, physical damage, or interference outside of our control. We carry backup equipment to minimize this risk.
• Photo and video deliverables, including formats and timelines, will be confirmed in your service agreement.
8. Equipment and Setup
Miami Vibes Entertainment provides and maintains all required equipment for your event. We arrive early for setup and testing. We carry backup equipment to every event to minimize the risk of technical issues.
We are not liable for equipment damage caused by the actions of event guests or venue staff. If our equipment is damaged during an event due to actions outside our control, the client may be responsible for repair or replacement costs as outlined in your service agreement.
9. Limitation of Liability
Miami Vibes Entertainment’s liability for any claim related to our services is limited to the amount paid for the specific service giving rise to the claim.
We are not liable for indirect, incidental, or consequential damages of any kind, including lost memories, event disruptions caused by third parties, venue issues, or circumstances beyond our reasonable control such as severe weather, illness, or emergencies.
In the event that we are unable to fulfill a booking, our sole obligation is to issue a refund of any deposits paid.

11. Governing Law
These terms of service are governed by the laws of the State of North Carolina. Any disputes arising from these terms or our services shall be resolved in Wake County, NC.
